Article 1 – Definitions
Supplementary Agreement: An agreement under which the consumer acquires products or services in connection with a distance contract.
Cooling-off Period: The period during which the consumer may exercise the right of withdrawal.
Consumer: A natural person not acting for purposes related to a trade, business, craft, or profession.
Day: Calendar day.
Durable Data Carrier: Any medium that enables the consumer to store information personally.
Right of Withdrawal: The right of the consumer to withdraw from the agreement within the cooling-off period.
Entrepreneur: van den Berg Holding B.V., trading under the name Minicar-Parts.
Distance Contract: An agreement concluded through an organized system for distance sales.
Return Portal: The digital return platform of Minicar-Parts.

Article 3 – Applicability
These terms and conditions apply to every offer and every distance contract between Minicar-Parts and the consumer.
For electronic agreements, the terms will be made available digitally so they can be stored by the consumer.
In the event of conflicting provisions, the one most favorable to the consumer shall prevail.
Article 4 – The Offer
Each offer contains a complete and accurate description of the products or services offered.
Obvious mistakes or errors do not bind Minicar-Parts.
The rights and obligations upon acceptance of the offer are clearly stated.
Article 5 – The Agreement
The agreement is concluded once the consumer accepts the offer.
Minicar-Parts confirms the order by e-mail and ensures secure data transmission.
If misuse or payment issues are suspected, an order may be refused or executed under specific conditions.
Article 6 – Right of Withdrawal and Return Policy
1. Right of Withdrawal for Consumers
Consumers have the right to return a product within 45 days after receipt, without giving any reason.
The cooling-off period starts on the day after the product is received by the consumer or a designated third party (not the carrier).
2. Registering a Return via the Return Portal
We kindly request that returns be registered via our online return portal:

This is our preferred route, as it allows us to process your return quickly and correctly.
Steps:
- Enter your order number or track & trace code.
- Select the items you wish to return and specify the reason.
- Choose a carrier and pay the shipping costs.
- Drop off the package with the selected carrier.
If you do not wish or are unable to use the return portal, you may also notify us of your withdrawal in another clear manner — for example, by email at helpdesk@minicarparts.nl.
Always include your order number, name, contact details, and which products you wish to return.
Please note that processing returns outside the portal may take more time.
3. Costs and Risk of Return
The consumer bears the return shipping costs.
The risk of damage, loss, or delay during transport lies with the consumer.
Costs for special transport (via Dachser or Pick This Up) are not reimbursed for returns, regardless of the reason.
Collection or exchange at the pickup location is not possible.
4. Returning in Person
Personal return is possible, provided that the return has been registered via the return portal.
In the portal, select the option “Return in person.”
5. Processing and Refund
After receipt, the return is usually processed within 7 days.
Refund of the purchase amount (including the initial shipping costs for consumers) takes place within 14 days after receipt.
Refunds will be made using the same payment method as the original transaction, unless otherwise agreed.
6. Conditions
- Products must be complete and in their original condition.
- Products must not be installed, used, or damaged.
- A reduction in value may be applied for products that can no longer be sold as new.
- Custom-ordered products cannot be returned unless expressly agreed otherwise.
7. Business Customers (B2B)
Business customers do not have a statutory right of withdrawal.
However, Minicar-Parts applies a lenient return policy:
- Return requests can be submitted within 45 days via the return portal.
- Each request is assessed individually.
- Shipping costs are not credited.
Article 7 – Obligations of the Consumer During the Cooling-Off Period
During the cooling-off period, the consumer must handle the product and its packaging with care.
The product may only be unpacked or used to the extent necessary to determine its nature, characteristics, and functioning.
Any depreciation due to improper use may be charged.
Article 8 – Exercise of the Right of Withdrawal and Related Costs
The consumer registers the return via the portal or by e-mail.
The product must be returned within 14 days after the notification of withdrawal.
The consumer bears the shipping costs and the burden of proof for correct return.
Article 9 – Obligations of Minicar-Parts in Case of Withdrawal
After receiving the notification, Minicar-Parts will send a confirmation.
Within 14 days after receiving the returned product, the purchase amount will be refunded via the same payment method.
Additional costs for more expensive shipping methods will not be credited.
Article 10 – Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
- Products that are custom-made or specially ordered;
- Digital content whose delivery has already started;
- Products that have been painted or modified at the customer’s request.
Article 11 – The Price
Prices are stated both including and excluding VAT.
Prices will not be increased during the validity period, unless required by law.
Article 12 – Performance and Warranty
Minicar-Parts guarantees that the products comply with the agreement and reasonable expectations.
Any additional guarantees do not affect statutory rights.
Article 13 – Delivery, Shipping, and Shipping Costs
Orders placed on working days before 15:00 are shipped the same day.
Delivery times are indicative. Shipping costs are calculated automatically.
Free shipping within the Netherlands for consumers from €150 and for business customers from €500 (excl. VAT).
Surcharge for DHL remote areas: €17.50.
Costs resulting from refusal or non-acceptance of a shipment are entirely at the customer’s expense, including return transport, administrative costs, and any reshipment charges.
Costs for special transport (via Dachser or Pick This Up) are not refunded in case of returns.
Article 14 – Payment
Payment is made via the payment methods available in the webshop.
For advance payments, the order will be processed after receipt of the payment.
In case of late payment, statutory interest and collection costs may be charged in accordance with the Dutch Debt Collection Costs Act (WIK).
Article 15 – Complaints Procedure
Complaints can be submitted via helpdesk@minicarparts.nl.
Minicar-Parts will respond within 5 working days and will seek an appropriate solution.
The consumer grants Minicar-Parts at least 4 weeks to resolve the complaint amicably.
